Annual rent

The owner of the establishment must pay the public property occupancy fee annually in order to operate the parklet.

This rent, set at a maximum of $100, is calculated by multiplying 15 per cent of the area occupied by the parklet on public property by the municipal assessment value per m2, based on the number of days of the occupancy.

Legislation

If you operate a business, manage an organization or represent a group of merchants and you want to build a parklet on the sidewalk or the road, you must get a seasonal public property occupancy permit.

You must send us an e-mail to check whether you are permitted to install a parklet in the desired location. Please include your contact information and the desired location in your e-mail.  

Once you have received confirmation that your application is admissible, you can fill out the online permit application form and attach all required documents.

You must renew your permit annually.

Fee

The technical review fee for the authorization of a new parklet is $706.00 plus taxes.

They will be invoiced after the end of the season.

Annual rent

There are no annual seasonal public property occupancy fees (rent) applied in the case of parklets.

Required documents

  • Proof of $2 million civil liability insurance rider, (one to two pages) that indicates the parklet is covered for the duration of the operating period and that designates the city as co-insured. The rider must also mention that the coverage cannot be canceled or reduced without 30 days notice to the relevant authority.
    • Full insurance policies will not be accepted. Only proof of insurance not exceeding 2 pages should be submitted.
    • Insurance policies that do not cover the entire period of occupancy and renewals during occupancy will be refused.
  • Professional-quality floor plan to scale, including:
    • the built facade of your establishment and the adjacent establishment, if applicable
    • the boundaries, dimensions and total area spanned by the proposed occupancy
    • the placement of the street furniture and the equipment belonging to various public utilities (lampposts, trees, garbage cans, etc.) within the occupancy area and around it up to a distance of 2 m 
    • the clearance areas prescribed by the by-law 
    • the height of the installation 
    • any other information required to ensure that the  occupancy is compliant with the applicable municipal regulations
  • List of construction materials
  • Document demonstrating that the parklet will meet the borough’s qualitative criteria
  • Written consent from the owner of the adjacent building, if the parklet encroaches on the front of the building

  • proof of third-party liability insurance coverage of $2 million, identifying “Ville de Montréal” as the co-insured party. This document can be provided after the permit application is approved

If applicable:

  • letter of authorization from the building owner
  • document authorizing the representative to act on behalf of the applicant

  1. ensure that your establishment is located in an authorized zone by contacting the Accès Montréal office
  2. submit an application for a seasonal public property occupancy permit at the technical studies office, making sure to attach the required documents and pay the processing fee
  3. once your project is accepted, sign the letter of requirement and build your parklet in compliance with the applicable standards

Annual rent

There are no annual fees (rent) applied to a periodic public property occupancy, except if your parklet is located on a parking lane.

 

If that is the case, you must pay a percentage of the real estate value of the area occupied by the parklet, calculated based on the number of days of occupancy between April 1 and October 31.

Temporary (pop-up) terraces are permitted throughout the year, with certain conditions.

  • proof of third-party liability insurance coverage of $2 million, valid for the entire operating period of the terrace. You will be asked to provide it when your application is reviewed, before the permit is issued

Before you install your parklet:

  • Proof that you operate the establishment and that the owner authorizes you to install a parklet, or proof you are the owner of the establishment 
  • A plan to-scale, showing the proposed design and details (materials, height, colour, location of vegetation, distance from street furniture, etc.) 
  • Elevation plan with details 
  • Details about protective planters if the site is not on a pedestrianized street
