Build a parklet on public property

Do you own or operate a business or represent an organization and want to build a parklet? Learn about the applicable standards that must be met.

In certain Montréal boroughs, you can build a parklet on public property during the summer and into the fall.

Public property includes:

  • the space between the private property limit and the sidewalk 
  • the sidewalk
  • the road

A permit is required to occupy public property on a seasonal basis, and standards apply.

Zoning check

Before taking steps to build a parklet, please check to make sure that your establishment is located in a zone where building a parklet is authorized (Village des Rapides) :

  • Rue Centrale sector, between Avenue Alepin and 7e Avenue
    • Maximum ten parklets or sidewalk cafés
    • Maximum two parklets or sidewalk cafés between two consecutive avenues

 

  • Rue Édouard sector, between 5e Avenue and 8e Avenue
    • Maximum 6 parklets or sidewalk cafés
    • Maximum 2 parklets or sidewalk cafés between two consecutive avenues

The sectors are listed in Schedule 1 of By-law LAS-0060.

Occupancy period

Building and removing a parklet is authorized between May 1 and October 15.

Business hours

You can operate your parklet from 7:00 a.m. to 9:00 p.m., seven days a week.

During non-operating hours, furniture must be removed or secured with a padlocked chain inside the premises.

Location

You can install the parklet only on a parking lane.

The parklet must not exceed 50 per cent of the area occupied by the business to which it is attached.

Under no circumstances can a parklet be built:

  • at a stop sign
  • in a bus or taxi lane
  • on a bike path

Layout standards

The parklet must:

  • Be on one level, with no protrusions
  • Have a platform at the same height as the sidewalk (wood, PVC or plywood boards)
  • Have a maximum capacity of 1.2 m2 per person (non-fixed seats) and one person per seat (fixed seats)
  • Be able to accommodate at least one person with reduced mobility

If a ramp is required, it must be at least 1.2 m wide and have a maximum slope of 1:12.

Features of the parklet must not exceed 1.07 m, with the exception of an umbrella.

Materials must be black, gray, brown, beige or natural for wood.

No plastic or PVC materials. The weight of the tables and chairs must be sufficient to prevent them from being blown over by the wind.

You must also install a protective planter along the side ends with reflective strips. The bin should contain natural plants. 

The parklet must have at least one garbage can built into the construction.

The parklet must not block a drain or cover a sump.

A sign maximum 0.1 m2 in size, indicating the capacity of the parklet and its status as a public place must be installed.

Restrictions

The following equipment is prohibited: Lighting, sound amplification or heating systems, coolers, tanks of combustible or flammable substances, vinyl, canvas or fabric.

It is prohibited to use sound equipment and present dance performances, theatre shows, film screenings, concerts and performances. Cooking or preparing food or drinks is also prohibited.

Posters, advertising or displaying a menu is prohibited.

A parklet, which consists of a platform extending from the sidewalk, features plants and accessories such as benches and bike racks.

No table service is offered in a parklet and the consumption of alcohol is prohibited. Only the consumption of food is permitted. 

Parklets are open to all residents.

Zoning check

Check to see if your establishment is located in a zone where parklets are allowed by emailing [email protected]; your email should include your contact information and specify the location.

Occupancy period

Building a parklet is authorized between April 15 and November 15.

Location

You can build the parklet on the sidewalk or the road, extending from the facade of your business or organization, or in front of a park or a vacant lot, on the  condition that it is maintained by a third party.

You are authorized to encroach on 30 per cent of the part located in front of the adjacent facade with the written consent of the building owner.

Under no circumstances can a parklet be built:

  • in front of a home
  • in a bus lane
  • on a bike path
  • within 5 m of an intersection

Building standards

The parklet must be located:

  • 0.5 m or more from the road right-of-way, not including the lane reserved for street parking
  • 0.5 m or more from street furniture, such as a garbage can or a bench
  • 0.5 m or more from the curb when street parking is permitted, in the case of a parklet occupying only the sidewalk
  • 1.5 m or more from a fire hydrant and sprinkler manifold (siamese connection)
  • 1 cm or more from a stop sign or a traffic light
  • 1 m or more from a traffic light with control box
  • 1 cm or more from a streetlamp
  • 0.5 m or more from a tree

The parklet must feature a low wall separating it from public property, except on the side adjacent to the sidewalk.

The low wall and the plants placed on the part of the parklet occupying the road must not exceed a height of 1.07 m. In order to maximize greening, we recommend that you build a low wall no higher than 0.9 m or that you use hanging plants if your low wall measures between 0.9 m and 1.07 m in height.

You must also place a protective planter in each corner of the parklet adjacent to the road. The planter must be between 0.5 m and 0.8 m in height, weigh a minimum of 75 kg, have reflective strips, and contain plants that do not exceed a height of 1.07 m.

You are required to cover the installation costs.

Cleanliness

You must install a 113-liter garbage can inside the parklet and empty it regularly.

Universal accessibility

  • The parklet must be constructed to be universally accessible
  • Its entrance, including the ramp for people with reduced mobility, must be at least 1.2 m wide and located in front of the establishment
  • If an access ramp is required, it must:
  • Have a slope no greater than 1:12 (5° or 8.33 per cent)
  • Be equipped with a railing on both sides and along its entire length.
  • Have bands with contrasting colours or textures, at each end (top and bottom).
  • Be located inside the parklet
  • Have a joint between the sidewalk or the road protruding no more than 1.3 cm

Restrictions

No element of the parklet can be affixed to public property.

It is prohibited to use sound equipment and present dance performances, theatre shows, film screenings, concerts and performances. Cooking or preparing food or drinks is also prohibited.

Occupancy period

If your parklet is installed on the sidewalk or road, the occupancy period is from April 1 to November 15.

Installation extension

Subject to approval, it may be possible to extend the period of installation of your parklet, if you make a commitment to maintain the area and clear any snow. In this case, you must submit a new permit application, which will be reviewed.

Location

You are permitted to encroach on the adjacent facade when it belongs to a ground-floor commercial space. The operator of this business and the owner of the building must consent in writing to the encroachment.

Under no circumstances can a parklet be built :

  •  in front of a home
  •  in a bus lane
  • on a bike path
  • at an intersection

Layout standards

In order to help you understand the standards, you can view the schematic drawing in the planning guide (please see below).

The parklet must meet the following conditions:

  • Minimum clearance of 2 m from the facade of the establishment that the parklet serves or from the street furniture at the back of the sidewalk, if applicable.
  • Maximum encroachment of 2 m on the road.
  • If located on the road, it must be more than 5 m from a street intersection. This distance is calculated from the start of the sidewalk curve radius. The same applies to the cross-street.
  • Not located in front of a driveway entrance, a bus stop zone or bus lane, in front of a parking space reserved for people with limited mobility, or in a no-parking zone.
  • Clearance of 0.5 m on both sides of any street furniture element.
  • Clearance of 0.5 m between the sidewalk café or parklet and the edge of the sidewalk, if applicable.
  • Clearance of 1 m on both sides of a fire hydrant if the platform is located on the sidewalk only.
  • Clearance of 1.5 m from both sides of a fire hydrant when a section of the platform is located on the road.
  • Does not obstruct a tree pit.
  • The furniture must be fixed in place and solid.
  • Includes at least one garbage can integrated into the construction.
  • Is not covered with a fixed shelter or a pergola.
  • A poster indicating the public character of the place must be displayed on the parklet, in plain view. 
  • If it includes furniture, 50 per cent of the tables must be designed to permit wheelchair access. The maximum height of these tables must be between 0.7 m and 0.9 m, and the tables must not have a central leg.

A parklet built entirely on the sidewalk is not required to have a platform.

If there is a platform, it must meet the following conditions:

  • Is on one level only, the same height as the sidewalk and flush with the curb.
  • Must be made of wood planks that are pressure-treated, stained, varnished or painted, and made from fibreglass, recycled plastic, or plywood with a regular surface.
  • Allows proper drainage from the surface of the platform.
  • Is solid and weather-resistant.
  • Can be built in sections, on the condition that the sections are attached.
  • The bottom of the platform must be closed on all sides, except for a section adjacent to the sidewalk to allow stormwater runoff.
  • The platform must be slip-resistant and must not be covered with a removable cover.

A parklet or a section of a parklet located on the road must include a railing or low wall separating it from public property, except on the side adjacent to the sidewalk.

The railings or the low wall must meet the following conditions:

  • Span all sides of the parklet, with the exception of the access points (sidewalk café only).
  • Must be between 0.9 m and 1.1 m in height.
  • Must be made of metal or wood.
  • Must harmonize with the platform, if applicable.
  • Must feature a significant natural vegetation component.
  • Must be stable and solidly affixed to the platform, if applicable.
  • Must provide universal access.
  • If it has openings, it should not be possible to fit a round object measuring less than 0.15 m in diameter through one of the openings.
  • The upper part of the railing must not be designed to serve as a shelf or as furniture.

A container used as a parklet must meet the following conditions:

  • Must be built of steel and be covered with a fixed roof surface.
  • Must not have any rust, and all the exterior surfaces must be painted.
  • Must have at least two exterior walls with openings over a proportion of at least 80 per cent of their surface area.
  • Its width must not exceed the outline of the parking space on the road, unless authorization to the contrary has been received.

A parklet’s occupancy of public property must meet the following qualitative criteria:

  • Healthy cohabitation with local activities (zoning)
  • Maintenance of peace and quiet in the community (good neighbourliness)
  • Harmonious integration into the built environment and the architectural heritage
  • Originality of the design concept
  • Quality of the materials and plants
  • Universal accessibility, safety and comfort

You are required to cover the installation costs.

  • Harmonious integration into the built environment and the architectural heritage
  • Originality of the design concept
  • Quality of the materials and plants
  • Universal accessibility, safety and comfort

A permit will not be issued in a residential zone.

Layout standards

The parklet must be located:

  • 1 m or more from the traffic lane
  • a maximum of 2 m from the curb in the case of a parklet built on the road
  • more than 5 m from the road curve at an intersection
  • 1 m or more from a fire hydrant and a sprinkler manifold (siamese connection)
  • 1 m or more from a stop sign or a traffic light
  • 0.5 m or more from a lamppost
  • 0.5 m or more from a tree

It must provide a pedestrian walkway measuring 1.5 m in width.

It must have a low wall separating it from public property, except on the side adjacent to the sidewalk.

The low wall and the plants placed on the part of the parklet occupying the road must not exceed a height of 1.07 m.  In order to maximize greening, we recommend that you build a low wall no higher than 0.9 m or that you use hanging plants if your low wall measures between 0.9 m and 1.07 m in height.

Each parklet must be authorized via an ordinance from borough council, according to the same implementation standards applicable to commercial terraces built on public property. However, no fees are charged for parklets.

Occupancy period

Borough council determines the occupancy period on a case-by-case basis. For example, if the parklet is authorized in winter and is located on a sidewalk, its operator must maintain it and clear the snow from it.

  • building a seasonal parklet (built in the spring and dismantled in the fall)
  • building a temporary parklet (built and dismantled daily from public property, in the morning and in the evening)

Universal accessibility

Your parklet must be accessible to persons with reduced mobility and have at least two spaces designated for them. Our teams will be inspecting parklets.

A parklet is an outdoor installation that is available to everyone, with benches, integrated tables and bicycle racks. It is separated from the building to which it is attached by a pedestrian crossing.

Parklets are built by merchants, organizations or institutions. They are built in front of buildings, parks or vacant lots.

Occupancy period

Parklets are authorized from April 15 to October 15. They must be dismantled at the end of the season.

Location

Parklets can be built in front of a building, a park or a vacant lot as well as on parking lanes and along the width of the sidewalk, as long as a passageway of at least 1.8 m is left free in front of the facade of the establishment.

Under no circumstances may you install a parklet:

  • In the space reserved for a bus stop
  • In a bike lane
  • Within 5 metres of an intersection

Standards for building a parklet

Parklets are not exclusively reserved for certain clients. They are public facilities. Parklets must meet the following standards:

  • They must be surrounded by a black ornamental wrought iron guardrail or a combination of black ornamental wrought iron elements, with a minimum height of 0.91 metres and a maximum height of 1.10 metres. At least 50 per cent of its surface on each side must be openwork.
  • Parklets must have a black, gray, brown, beige or natural wooden floor whose height is adjusted to the sidewalk.
  • From the curb, your parklet must not encroach on the street further than two metres.
  • On Rue Wellington, the line of granite or concrete paving blocks on the sidewalk must not be pierced.
  • Umbrellas are the only items allowed to protect against sun and rain. They must not exceed the aerial limits of the parklet.
  • The parklet may exceed the boundaries of the establishment on the sides if site conditions permit and the establishment’s neighbour has agreed.
  • It must be surrounded by natural plants on at least two-thirds of each side.
  • The interior of the parklet must be suitable for pushing a stroller or wheelchair.
  • A poster no longer than .12 metres that states that the parklet is a public space must be displayed. It can include a small logo.
  • You must keep the parklet properly maintained and make sure it has its own garbage can.
  • Lighting can be used as long as no electrical wires obstruct the sidewalk or cross public property to reach the building facade.
  • Furniture must be attached to the floor or structures.
  • A tree located inside the development must be surrounded by a guardrail or a wall located at least .80 metres from its trunk. The tree pit must not be covered.
  • Parklets that only occupy a portion of excess width on the sidewalk must have a clearance of at least .20 metres from the edge of the sidewalk.
  • A protective bin that meets borough specifications must be installed at each end of the parklet in the street. When you submit your plans, we will inform you whether the borough is able to provide them.

Restrictions

  • The consumption of alcoholic beverages is prohibited.
  • Dancing, theatrical or cinematographic performances, concerts, shows, the use of sound devices and cooking food are prohibited.
  • All furniture should be designed and treated for the outdoors. Both the parklet and its furniture must be properly maintained and cleaned as often as needed. Furniture cannot be removable. It must be fixed to the floor or structures.

  • 1.5 m or more from a fire hydrant and sprinkler manifold (siamese connection)
  • 1 m or more from a tree

The parklet must feature a guardrail separating it from public property, except on the side adjacent to the sidewalk. It must have reflective strips along the road.

The guardrail and the plants placed on the part of the parklet occupying the road must not exceed a height of 1.07 m. In order to maximize greening, we recommend that you build a guardrail no higher than 0.9 m or that you use hanging plants if your guardrail measures between 0.9 m and 1.07 m in height.

You must also place a protective planter in each corner of the parklet adjacent to the road. The planter must be a minimum of 0.9 m in height, weigh a minimum of 50 kg, have reflective strips, and contain plants that do not exceed a height of 1.07 m.

You are required to cover the installation costs.

Restrictions

No element of the parklet can be affixed to public property.

It is prohibited to use sound equipment and present dance performances, theatre shows, film screenings, concerts and performances. Cooking or preparing food or drinks is also prohibited.

Get a permit

A permit is required to build a parklet on public property. 

The permit can be renewed annually.
