Disclose a loss of exemption for property transfers

Were you exempted from property transfer duties when you purchased immovable property? Did you lose your exemption due to stock transfer within your company? You must notify the city.

Québec’s Act respecting duties on transfers of immovables defines situations in which a buyer can be exempted from property transfer duties. However, changes may occur after the transaction that cause you to lose that exemption. 

For example, when a natural person (an individual) transfers immovable property to a legal person (a corporate entity) in which he or she owns at least 90% of the stock, the transaction is exempt from property transfer duties. However, if there is a change in shareholders within 24 months of the transfer of the immovable property, the exemption may be lost. 

If you lose your exemption, you have 90 days to notify the city. The city will then issue an invoice for the property transfer duties.

You must complete the disclosure form and e-mail us one of the following documents: 

  • Certified copy of the original notarial deed 
  • Copy of the private agreement recording the transfer of the immovable property.
