Sell a property that is subject to the pre-emptive right
Are you the owner of a property subject to Montréal’s pre-emptive right (also known as right of first refusal) for which you have accepted a purchase offer? Please tell our teams.

You must advise us in advance of the sale of your property, if you have received, during the last 10 years, an official letter titled “Avis d’assujettissement au droit de préemption” (“Notice of Pre-Emptive Right”), you have accepted a purchase offer and its conditions have been fulfilled.
The Ville de Montréal has 60 days to decide if it wants to purchase the property according to the conditions stated in the purchase offer. After this period, the sale can take place as planned.
You may also sell the property directly to Montréal: even before putting your property on the market, you can negotiate a price directly with the municipal administration.
Documents to provide
Fill out a Notice of intent to alienate an immovable (in French) and assemble the following documents:
- Signed and accepted purchase offer
- Non-monetary consideration, if applicable, and report on the estimated monetary consideration
- Resolution or power of attorney designating the agent
- Certificate of location
- Leases
- Real estate broker contract
- Environmental impact studies, if any
- Property evaluation report, if any
These documents could be subject to a request for access to information. If you consider certain information to be confidential, please let us know when you submit your notice.
