Defence and prosecuting attorneys can submit an application for a pre-trial conference and can arrange to have the hearing held jointly.
The pre-trial conference is a meeting held before the trial, in the presence of a judge, for purposes of discussing matters that can be resolved more effectively before the start of proceedings. It can be initiated by the accused, the lawyers or the judge.
Submit an application
- The lawyers must complete the “Joint request for a pre-trial conference.”
- This request form is available at Counter 6 on the ground floor of the municipal court.
- The original of the request must be filed in the judges’ chambers.
- The pre-trial conference request must be submitted during the pro forma hearing. Records subject to a fixed trial are thus excluded.
- The pre-trial conference is held in the presence of the prosecuting attorney and the defence attorney representing the parties during the case hearing, which excludes the possibility of being replaced by a trainee or a colleague who is unable to make decisions concerning the conduct of the trial.
Use of videoconference rooms during the hearing
When a lawyer wishes to speak to their client during the hearing, the following procedure applies:
- The lawyer must first get authorization from the presiding judge.
- The lawyer enters the meeting cubicles in compliance with the procedure in place.
- The lawyer establishes communication with the videoconference room at the operations centre where the detainee is waiting.
