Install an above-ground pool
Want to install an above-ground or portable pool on your property? You are required to obtain a permit, and you must comply with the applicable regulations. The following is an overview of the standards you must meet to ensure that your installation is compliant.
When installing an above-ground or portable pool, you must meet certain provincial standards, to which may be added the requirements of your borough.
A new provincial regulation came into effect in 2021. It applies to pools and spas of more than 2000 liters and a depth of 60 cm or more, regardless of when they were installed.

Location of an above-ground or portable pool
Your swimming pool must be located at least one metre (3 ft. 3 in.) from any private property line.
It cannot be installed in a front yard.
No tank or underground construction related to a tank may be located within an easement (servitude).
Safety fence
It is not mandatory to install a fence around an above-ground pool if the side walls measure at least 1.2 m in height or around a portable pool if the side walls measure at least 1.4 m in height, and if the pool is accessed from:
- a ladder equipped with a safety gate that closes and locks automatically
- a ladder or platform with protected access via a compliant gate
- a terrace attached to the building and constructed with a compliant gate restricting access to the pool
Equipment around the pool
For greater safety, the equipment required to operate your pool must be installed more than 1 m from the pool side wall or from the fence, except if it is located:
- inside the fence
- beneath a structure restricting access to the pool
- in a shed
The pipes and hoses connecting the accessory equipment to the pool must be flexible and must not be installed in a way that facilitates climbing the pool side panels or the fence.
Get a permit
A permit is required to install an above-ground or portable pool with a depth of at least 60 cm (2 ft). This permit also authorizes you to:
- build a platform to access the pool
- install a fence
- fell a tree (if the pool cannot be installed in a different location)
- set up any other equipment required to install the pool
If you have already obtained a permit for your portable pool, you are not required to submit a new application to reinstall the same pool next year, in the same place and under the same conditions.

You must install your pool at least 1.3 m from your property limits. It is prohibited to install a swimming pool in a front yard.
If the length of the rear yard is less than 6 m, you may install your pool in a secondary front yard or a side yard.
A swimming pool may be sited where a tree is located only if the pool cannot be installed anywhere else on the lot (excluding portable pools).
Safety fence
A fence must surround any above-ground or portable pool whose walls are lower than 1.2 m. The fence must:
- Be located at least 1 m away from the edge of the pool
- Stand at least 1.2 m tall
- Be no more than 10 cm from the ground
- Have no projecting or recessed device or hole that could make climbing possible
The fence may have bars, as long as they are separated by spaces less than 10 cm wide.
When a wall is part of the fencing around your pool, it must not contain any opening that allows access to the pool.
The fence gate must have a safety latch that allows it to close and lock automatically. This device must be installed on the inside of the fence, in the upper part of the gate.
You cannot use a hedge or bushes as a fence.
Fence requirement exceptions
It is not mandatory to install a fence around an above-ground pool if the side walls measure at least 1.2 m in height or around a portable pool if the side walls measure at least 1.4 m in height, and if the pool is accessed from:
- a ladder equipped with a safety gate that closes and locks automatically to prevent a child from using it
- a ladder or platform with protected access via a compliant gate
- a terrace attached to the home and constructed with a compliant gate restricting access to the pool

For greater safety, the equipment required to operate your pool must be installed more than 1 m from the pool side wall or from the fence, except if it is located:
- inside the fence
- beneath a structure restricting access to the pool
- in a shed
The pipes and hoses connecting the accessory equipment to the pool must be flexible and must not be installed in a way that facilitates climbing the pool side panels or the fence.
Get a permit
If you want to install or replace an above-ground or portable pool with a water depth of 60 cm (2 ft) or more, you must obtain a permit.
Another permit is required to:
- Fell a tree in the area where you plan to install the pool
- Construct an access platform for the pool
- Modify a balcony attached to the building so a part of it opens onto the pool
If you have already obtained a permit for your portable pool, you are not required to submit a new application to reinstall the same pool next year, in the same place and under the same conditions.
If you wish to change or replace an existing platform, you are required to obtain the necessary permits.

- a ladder or platform with protected access via a compliant gate
- a terrace attached to the building and constructed with a compliant gate restricting access to the pool
Equipment around the pool
For greater safety, the equipment required to operate your pool must be installed more than 1 m from the pool side wall or from the fence, except if it is located:
- inside the fence
- beneath a structure restricting access to the pool
- in a shed
The pipes and hoses connecting the accessory equipment to the pool must be flexible and must not be installed in a way that facilitates climbing the pool side panels or the fence.
Get a permit
A permit is required to install an above-ground or portable pool with a depth of at least 60 cm (2 ft). This permit also authorizes you to install a fence to restrict access to the pool.
If you have already obtained a permit for your portable pool, you are not required to submit a new application to reinstall the same pool next year, in the same place and under the same conditions.
If you wish to change or replace an existing platform, or if you must fell a tree, you are required to obtain the necessary permits.
