Do you own a commercial or industrial building? Before doing any expansion work you need a permit. You must also make sure you comply with the bylaws in effect.

To enlarge your building, you need a construction permit. Find out how to apply for a permit in your borough.

Some areas and properties are subject to particular standards to preserve their historic, architectural or landscape value. Additional documentation, such as a Site Planning and Architectural Integration Plan (SPAIP), may be required.

Rules to follow

  • You must check to see if increasing the floor area is allowed for the planned use. Some uses, in particular those operating as an acquired right, have limitations.
  • You must comply with the maximum site coverage of the building on the parcel
  • Make sure that the use is authorized if you are adding building height
  • To modify the appearance of an existing building, check to see if the project complies with the regulation for the zone where it is located
  • The enlargement of a building may require an increase in the number of parking spaces or the creation of loading units, depending on use

Permit fees

Processing fees for permit applications vary based on the projected cost of the work. You will be required to pay $9.80 for every $1,000 of work.

Regardless of the amount of work, you will be required to pay a minimum of $473 for a commercial, industrial, institutional or mixed-use building.

The cost estimate must include all expenditures related to the work, including plans, labour, equipment, etc. including taxes.

The fees are non-refundable.

You must get a permit before beginning your project. 

Applicable standards

A number of standards, criteria and objectives must be met in order for your expansion project to be authorized. Up to 15 regulations may apply. Whether it’s a question of site ratio, height, use, park fees or connection to public networks, a permit application will confirm that your building can be expanded in compliance with all applicable standards. 

Before you begin your project, you can check the interactive map (in French). Just enter the address in the search bar and select the “Zonage and PIIA” (“Zoning and SPAIP”) tab). Then, visit the permit counter or send us an e-mail to find out about applicable standards and regulations. It is the project designers’ responsibility to ensure that all by-laws, standards and regulations are observed. 

Required documents

The following documents are required for the preliminary review of your application:

  • Certificate of location 
  • Building data sheet (exempt (in French) or non exempt (in French)) 
  • Architectural plans (existing and projected plans, elevations of facades, cross-sections and longitudinal sections, complete plans of all levels specifying the function of each room, any other plans relevant to the application) 
  • Estimates, including taxes and professional fees 
  • Power of attorney (if application is submitted by an individual other than the owner) 
  • Resolution from the board of directors (if application is submitted by a legal entity) 

 Applications cannot be processed without all required documents and payment of the permit review fee. 

Additional documents, related permits and financial contributions may be required to evaluate the project. 

Certain expansion projects are subject to a SPAIP evaluation by the urban advisory committee. To check whether your project is affected by this by-law, please consult the borough’s By-law concerning site planning and architectural integration (in French)

Fees 

The cost to review a permit application varies depending on the cost of your project. You must pay $9.80 for each $1,000 of work being carried out. 

No matter the cost of your project, you must pay at least: 

  • $161 for a residential building 
  • $473 for a commercial, industrial or institutional building 

The cost estimate must include all expenditures related to the work, including plans, labour, equipment, etc. including taxes.

Additional fees may apply if your building, or the area in which it is located, has historical value or is subject to special architectural standards. 

Fees are non-reimbursable. 

Permit validity period 

Permit validity varies depending on the type of construction work. Several conditions must be met. 

The permit is no longer valid if: 

  • Construction has not begun within 12 months of the permit’s date of issue, or within 18 months in the case of a building more than 4 storeys high or with a building area exceeding 2,000 square metres. 
  • Construction is interrupted for more than 6 months. 

Construction must be completed within 18 months of the permit issue date, or within 24 months in the case of a building more than 3 storeys high or with a building area exceeding 600 square metres. 

Permit renewal 

The permit validity period can be extended if: 

  • The project has not started. 
  • The renewal application is submitted before the validity period expires. 

Renewal fee: 25 % of the cost of the original permit. 

The processing fees are not taxable, but taxes are calculated in the projected cost of the work.

  • Location of any existing or planned right of way
  • Delineation of high and low velocity zones
  • Survey of existing trees
  • Exterior developments (parking areas, access roads, loading and unloading areas and driveways)
  • Location of existing element(s) on public property facing the lot in question (tree, fire hydrant, gas line, etc.)
  • Calculations and plans for any stormwater retention structure

For an extension of the area of an existing building: 

  • Implementation plan and certificate of location including the same information required above.
